The Labour Standards Act prohibits discrimination against employees on the ground of sex, nationality, religion or social status.
Discrimination is also prohibited under other statutes including the following:
- The Employment Promotion and Vocational Rehabilitation of Disabled Persons Act, which provides that employers must not discriminate against disabled employees.
- The Equal Employment Act, which prohibits discrimination against female employees.
- The Employment of Foreign Workers Act, which provides that employers must not discriminate against foreign workers once they are employed. However, it also provides that before hiring a foreign worker, the employer must make active efforts to employ a Korean worker.
- The Fixed-Term and Part-Time Employee Protection Actand Dispatched Workers Protection Act, prohibits discrimination against non-regular workers.
- The Act on Prohibition against Age Discrimination in Employment and Promotion of the Elderly Employment prohibits age discrimination.
Sexual harassment in the workplace is prohibited under the Equal Employment Act. Employers are required to hold sexual harassmentprevention education classes at least once a year. Employers must also reprimand any employees found to be engaging in sexual harassment in the workplace.
